Development Fees and Charges

Development fees and charges are important to our city planning and growth. They fund public services and infrastructure required to support new growth.  

Community benefit charges 

In the past, Section 37 of the Planning Act allowed cities to permit taller or denser buildings in exchange for community benefits, known as density bonusing. This has been replaced with Community Benefits Charges, which are fees we can apply to new residential developments that are at least five storeys in height and that provide at least 10 residential units, with some exceptions.

Development charges 

We charge fees for future development needs. These fees are collected through the Development Charges Bylaw and cover services like roads, safety, transit, parks and other services. You pay these fees before getting a building permit or when connecting to water and sewage services if you don't need a permit. 

The Development Charges Act gives cities the authority to create rules to charge property owners for the costs of improving services due to development. 

In Kingston, we use the Development Charges Bylaw to collect these charges. The bylaw lists the services subject to charges and the rates for different types of development. Charges are adjusted every Jan. 1: 

    • Schedule A: List the municipal services that require development charges. 
    • Schedule B: Specify development charges for city-wide services and for water and wastewater services within the urban service area based on development type.  

The Development Charges Pamphlet, updated yearly, outlines the City's rules on development charges. It is a guide, so applicants should check the bylaw and talk to the City's Building Services Department for specific charges. 

Development charge exemptions

Bill 108, the More Homes, More Choices Act, 2019, Bill 23, the More Homes Built Faster Act, 2022, and Bill 185, Cutting Red Tape to Build More Homes Act, 2024 outline various payment options, exemptions and redevelopment credits. 

For complete applications accepted by the City, development charge rates can be frozen at the time of complete application submission for a period of eighteen months starting from the date that the planning department issues conditions of approval for site plan control or zoning bylaw amendments. If neither site plan control nor zoning bylaw amendments are applicable, the rate payable is determined at the time of issuing the first building permit. 

The following types of development can pay development charges in six annual instalments starting at the time of building occupancy: 

  • Rental housing (4 or more units in the building)
  • Institutional development (as defined by the legislation) 

The first payment is due on the date the building is first occupied or the date of issuance of an occupancy permit. Each of the additional five payments will be due on the anniversary of the occupancy date, payable with accrued interest at the Bank of Canada prime rate plus one percent as per the Development Charges Act. 

Rental housing developments consisting of four or more residential units are discounted development charges based on the number of bedrooms: 

  • 25% for three or more bedrooms
  • 20% for two bedrooms
  • 15% for bachelor and one bedroom 

Additional second and third residential units are exempt from development charges on properties containing single, semi or row house buildings. The additional units can be either both within the main building, or one in the main building and one in a detached  building. 

  • Single, Semi or Row House pays development charges
  • Second and Third unit exempt from development charges 

Non-Profit Housing that are in good standing and whose primary objective is to provide housing are exempt from development charges for: 

  • A corporation to which Not-for-Proitt Corporations Act, 2010 applies
  • A corporation without share capital to which the Canada Not-for-Profit Corporations Act applies
  • A non-profit housing co-operative under the Co-operative Corporations Act 

Anyone seeking an exemption from the City of Kingston Development Charge Bylaw must complete the Application for Development Charge Exemption. 

Properties undergoing redevelopment, change of use, or demolition are eligible for a credit against owed development charges, limited to the current rate and not exceeding the payable amount. However, for demolitions, credit eligibility is restricted to redevelopments occurring within 5 years of the issuance of a demolition permit for a qualifying residential or non-residential building. 

Rules for development related charges

Development charges apply to all lands in our city. Charges for water and wastewater services apply only to developments in the urban service area of our city. 

Development charges must be paid before a building permit is issued. If a building permit is not required, fees must be paid when connecting to the water and/or wastewater system(s). 

Development charges can be reduced under the City of Kingston Development Charge Bylaw when demolishing or redeveloping a residential, non-residential, or mixed-use building or structure. This applies if the building or structure was occupied within the last five years or if a demolition permit was issued within five years before a redevelopment building permit. 

The schedule of development charges is updated annually on January 1, based on the most recent year-over-year change in the Statistics Canada Quarterly "Construction Price Statistics" for the Ottawa Region. 

The Office of the City Clerk and our website provide an annual statement to Council that reflects the activity of the Development Charge Reserve Fund, including the information outlined in Section 12 of Ontario Regulation 82/98.
